Y. H. McQuarie, as administrator upon the estate of John F. Smith, brought suit against the defendant insurance company, to recover on a policy of insurance for $10,000 which the *234deceased secured in Ms lifetime, and to cancel a certain deed given by the insured to the insurance company to secure a loan of $10,-000, the plaintiff insisting that one claim was offset by the other.
