I. INTRODUCTION

Previously in this case, the Court ruled that the defendant’s collection letter violated the Fair Debt Collection Practices Act (“FDCPA”), 15 U.S.C. § 1692 et seq. Plaintiff Jeffrey Macarz now moves to certify the case as a class action. Defendant Trans-world opposes class certification, primarily on grounds that Mr. Macarz is neither typical nor a fair representative of the interests of the class, and that the class action vehicle is improper in the circumstances of this case.
