This is an appeal from a decree of distribution made and entered by the superior court of the city and county of San Francisco.

The case here presented turns on the meaning of the following portion of the will of the deceased above named:—

*367“ I give and bequeath to my said husband, John B. Reinhardt, the use and income of all my property of which I may die possessed, to his sole use and benefit, as long as he remains my widower; provided, however, and it is hereby made an express condition, that he shall not be authorized to sell, convey, or dispose of, or mortgage or in any way…
