HONORABLE EDGAR J. BAKER, District Judge,

sitting in place of MR. CHIEF JUSTICE CALLAWAY, disqualified, delivered the opinion of the court.

In this action the plaintiff sets forth a cause of action against the defendant, his wife, for divorce upon the ground of wilful desertion. To this a general demurrer was interposed, which was by the court overruled, and this ruling, amongst others, is assigned as error.
