Haymond, Judge:

The defendant, Charles Hinkle, was indicted for a felony by the grand jury which attended the Circuit Court of Upshur County, West Virginia, at the regular April Term, 1946, of that court. The indictment charges that the defendant, Charles Hinkle, “on the 21st day of January, A.
