At the regular April Term 1958 of the Circuit Court of Monongalia County, the defendant Andy Pastoría was indicted for a felony by the grand jury attending that term of court. The offense charged in the indictment is that in January 1958, in Monongalia County, West Virginia, the defendant, well knowing that Charles J.
