This cause comes before the Court upon Defendant PrimeTime 24 Joint Venture’s Renewed Motion for Summary Judgment, filed October 6,1997 (D.E.# 167).

BACKGROUND

This action involves an infringement dispute over Plaintiffs’ 1 exclusive rights in copyrighted network television programs. Plaintiffs CBS, Inc. (“CBS”), and Fox Broadcasting Co.
