OPINION
PAGE, Justice.
Appellant David Arthur Spaeth was arrested on July 7, 1994, in connection with the July 6, 1994, murder of Linda Larsen at her home in Bloomington, Minnesota. Spaeth was subsequently indicted for Larsen’s mur der and convicted of first-degree murder in violation of Minn.Stat. § 609.185(3) (1994), first-degree burglary in violation of Minn. Stat. § 609.582, subd. 1(a), and first-degree assault in violation of Minn.Stat. § 609.221 following a jury trial in Hennepin County.
