The appellant, Thomas J. Kiely, resides at 5622 North Uber Street, Philadelphia, Pennsylvania, and is an operative builder. He was originally tbe owner of a tract of land bounded on tbe north by Chew Street, on the south by Olney Avenue, on the west by Twentieth Street, and on the east by Uber Street, in the City of Philadelphia.

The appellant constructed a row of houses fronting on Uber Street and bounded on the north by the said Chew Street, on the south by a ten feet wide driveway located on his property, and on the west by a twelve feet wide driveway bisecting said…
