The appellees were the owners of certain real property in Mitchell county, Iowa. It is the claim of the appellants that on or about the 13th day of July, 1912, the appellees offered to sell said property to the appellants for a' consideration of $98 per acre, $500 of the consideration to be then paid, the balance to be paid March 1, 1913, when conveyance should be made, subject to an existing mortgage for $8,500 then against the property, which mortgage drew 5 per cent., the grantees to assume the mortgage, with interest from March 1, 1913.
