Appeal from Plymouth District Court. — Hon.- F. R. Gaynor, Judge. Action for the specific performance of an alleged oral contract for the conveyance of real estate by one Duncan Ross, now deceased, the father of the plaintiff and an ancestor of the defendants. The trial court denied the relief asked, and plaintiff appeals.

In the latter part of that opinion is a suggestion of the claim made in this action. After that suit was brought and while it was pending in this court upon appeal, plaintiff commenced this action and his claim as disclosed by the petition is:
