The defendants were charged in an information filed by the district attorney of Fresno County with the commission of a felony, to wit, the violation of section 16 of the Deciduous Fruit Dealers Act (Stats. 1929, p. 665). The information contains two counts. In the first count- it is alleged that the defendants wilfully and unlawfully engaged in the business of dealer in deciduous fruits as defined in the act without having procured a license so to do.
