The plaintiff in error was convicted in the Hudson County Court of Oyer and Terminer of the crime of murder in the first degree, and sentenced to be executed for that crime. The court before which the trial was had was, in the absence of a Supreme Court justice, held by the judge of the Court of Common Pleas of the county *277of Hudson, sitting alone, in pursuance of section 3 of the Criminal Procedure act.
