The plaintiff in error was indicted for the murder of Charles Gebhardt, a police officer of the city of Hoboken. The indictment was found in the Court of Oyer and Terminer of the county of Hudson. It contained two counts — first, the statutory form prescribed by section 45 of the act regulating proceedings in criminal cases. Rev., p. 275; Pamph. L. 1898, p. 866, § 36.
