This appeal is from a judgment entered in the District Court on a jury verdict for defendant in a personal injury action against the manufacturer of a pullshovel.

Plaintiff, Morrocco, was a construction worker employed by a sewer contractor. He was engaged in laying sections of concrete sewer pipe into an excavation which was made by the pullshovel. The pull-shovel, which was commonly known as a “Northwest Back Hoe” had been purchased new by the contractor only three days prior to the accident.
