OPINION OF THE COURT

BURD, Judge:

On 23 November and 20-23 December 1998, the appellant was tried by general court-martial composed of officer and enlisted members at Incirlik Air Base (AB), Turkey. Contrary to his plea, he was found guilty of wrongfully distributing lysergic acid diethylamide (LSD) while receiving special pay under 37 U.S.C. § 310, in violation of Article 112a, UCMJ, 10 U.S.C. § 912a. He was found not guilty of wrongfully using LSD while receiving special pay. The adjudged and approved sentence consisted of a bad-conduct discharge, confinement for 1 year, forfeiture of all pay…
