The Appellant insurance company issued a fire policy to and in favor of one Giljevich upon a certain building and-contents to'the 'amount of $800; and thereafter, while said insurance w'as in force, said building and contents were wholly destroyed by fire. Giljevich presented his claim for loss to appellant and payment thereof was refused. Giljevich thereafter commenced an action against appellant to recover for such loss.
