Appellees, Cyrus Barnard and Ambrose Barnard, partners doing business under the firm name of “C. Barnard & Son,” instituted this action for the recovery of money and to enforce a seller’s lien upon certain described lumber, which, as they alleged, was in their possession. In the first paragraph of their complaint they state substantially, that in May, 1893, they owned and operated a saw-mill and lumber yard in the town of Greensboro, Henry county, Indiana; that they had, upon their yard, a large amount of oak and other lumber; that prior to May, 1893, at divers times, they sold to one Herbert…
