This case is before the court on the Report and Recommendation of the Magistrate Judge (the “R & R”) [Doc. No. 32]. The R & R recommends that the court grant the Motion to Dismiss and for Partial Judgment on the Pleadings [Doc. No. 8] filed by Defendants Home Depot U.S.A., Inc. (“Home Depot” or “the Company”), Tim Hourigan (“Mr. Hourigan”) and Sarah Longacre (“Ms. Longacre”) (collectively “Defendants”).
