The appellant, James E. Wilson, is a beneficiary under the last will and testament of the late Mrs. Julia L. Snyder, of Baltimore County, and is also the obligee under a contract with her executed eight years before her death in May, 1942. Specifically, under the terms of the will and two codicils thereto, he is entitled to (1) the release of a $3,000 mortgage held by her; (2) an annuity of $900 a year, and (3) the conveyance of a portion of the real property owned by the testatrix at “Holly Point” on the Severn River in Anne Arundel County.
