—Appeal from an order of Supreme Court, Erie County (Makowski, J.), entered July 2, 2001, which, inter alia, denied plaintiff’s motion for summary judgment.

*1018It is hereby ordered that the order so appealed from be and the same hereby is unanimously modified on the law by granting that part of plaintiff’s motion seeking summary judgment against defendant Christopher Knight and as modified the order is affirmed without costs.
