Quinn, Judge:

Pursuant to Article 67(2), Uniform Code of Military Justice, 10 USC § 867, the Judge Advocate General of the Navy has asked this Court to review the correctness of a determination by the United States Navy Court of Military Review “that the convening authority is empowered to overrule and reverse a military judge’s ruling on a speedy trial issue.” We answered that question in the affirmative in United States v Boehm, 17 USCMA 530, 38 CMR 328 (1968), and reaffirmed the answer in Lowe v Laird, 18 USCMA 131, 39 CMR 131 (1969).
