The defendant, a fraternal benefit association, organized under the laws of the state of Iowa, appeals from a judgment rendered in the district court for Douglas county. The defendant was authorized to do business in Nebraska at the time it issued the beneficiary certificate sued on. On or about March 17, 1910, Thomas Cunningham, who was then residing at Mitchell, South Dakota, through the local lodge at Mitchell, presented his application for membership to the defendant.
