FRANK A. KAUFMAN, Senior District Judge.(1) Reference is hereby made to defendant Leonard F. Binder’s motion to dismiss the individual plaintiffs claims against him for lack of subject matter jurisdiction. Pursuant to Federal Civil Rule 12(h)(3), that motion will be granted as to defendant Leonard F. Binder.
