David Wayne Mills was convicted in a jury trial of first-degree murder in violation of Code § 18.2-31; attempted burglary in violation of Code §§ 18.2-91 and 18.2-26; and use of a firearm in the commission of a felony, as a principal in the second degree, in violation of Code § 18.2-53.1. Mills challenges the convictions on grounds that the trial court erred in (1) failing to suppress evidence discovered during a warrantless search by a private citizen who was acting as an agent of the government and (2) failing to suppress incriminating statements he made after law…
