The controversy in this case centers around an Army Corps of Engineers’ contract to clean up a hazardous waste site in New Jersey. Plaintiff Ensco Environmental Services, Inc. (“EES Inc.”) was low bidder on the contract, but was not awarded the contract. The Corps of Engineers felt that its bid was unresponsive to the bid specifications because its bid guarantee was invalid.
