This matter is before the court upon defendant Barry Garfinkel’s objections to a Report and Recommendation of United States Magistrate Judge Floyd E. Boline dated May 19, 1993 (“Report and Recommendation”). Garfinkel objects to the magistrate judge’s recommendation that his motion to dismiss counts 5 through 23 of the indictment (“counts 5 through 23”) or, in the alternative, for a bill of particulars with respect to counts 5 through 23 be denied.
