*462The plaintiffs have charged the defendants, including Toshiba Corporation ("Toshiba-Japan”) and Toshiba America Corporation (“Toshiba-US”), with infringement of several patents; Toshiba-Japan and Toshiba-US have responded with a counterclaim for a declaratory judgment that they have not infringed the patents-in-suit, and that they are invalid and unenforceable.
