delivered the opinion of the court.

December 20, 1900, the Probate Court of Cook County made the following order:

“In the Matter of the Estate Joseph Klicka, deceased.

This cause coming on to be heard on the application of Alvina H. Klicka, the widow of Joseph Klicka, deceased, for partial distribution of the assets of the estate of said decedent, and it appearing to the court that said estate is amply solvent, it is ordered that the Equitable Trust Company, executor of the last will and testament of said Joseph Klicka, deceased, make distribution of the sum of one thousand…
