BACKGROUND

Plaintiff, William Morrissey, brought this employment discrimination action in state court after his employer, the Boston Five Cents Savings Bank, forced him to retire upon reaching his 65 birthday. Morrissey asserted claims against the Boston Five Cents Savings Bank and certain board members (collectively, “the Bank”) under the Age Discrimination in Employment Act (ADEA), 29 U.S.C. § 621 et. seq., Mass.Gen.L. ch. 151B § 4, and Mass.Gen.L. eh. 93, §§ 102-103.
