VANCE, District Judge.
Before the Court is third-party defendant Diesel Specialists, Inc.’s motion for summary judgment. For the reasons that follow, the motion is DENIED.
I. BACKGROUND
This suit arises from a fire that allegedly occurred on board the MW LACABI on October 11, 1995. The MTV LACABI is a 78 foot tug that was owned by plaintiff Barnacle Marine Management, Inc.
