The matter being considered here is the Defendants’ Motion for Summary Judgment. These Findings and Conclusions are based upon a consideration of the record as a whole including the Parties’ Written Memoranda.

Summary judgment may be rendered if the pleadings, depositions, answers to interrogatories, and admissions on file, show that there is no genuine issue as to any material fact and that the moving party is entitled to a judgment as a matter of law.
