This was an action commenced June 27, 1883, in the district court of Pottawatomie county, by John Boh against James Roby, Nancy J. Sellers, Andrew J. Hodge, and A. D. Walker, to quiet title to the east half of tbe north*355east quarter of section 9, township 7 south, of range 12 east, in said county. The action was not commenced under § 594 of the civil code, nor under any other section of the Kansas statutes, but was commenced as an equitable action under the general principles of equity.
