GLASSMAN, Justice.

Joshua Nadel appeals from a judgment of the Kennebec County Probate Court (Mitchell, J.) denying his petition seeking appointment as a guardian for James John L., born September 21, 1984, the child of Beth and George. By a previous court order, Beth had the physical custody of James and George had rights of visitation with and support obligations for James.
