This case is for damages arising from personal injuries sustained by the plaintiff and caused by being run over by one of defendant’s carriages. The judgment below' was for plaintiff, and defendant has brought the case here.

The team was being driven by a hack driver, and one of the principal questions in the case is, was he defendant’s servant*? There are also two other questions discussed by the respective counsel, viz., negligence of the hack driver, and contributory negligence of the plaintiff.
