This appeal grows out of a suit which involved the Workmen’s Compensation Act, Vernon’s Ann.Civ.St. art. 8306 et seq. Ap-pellee G. A. Roberts, as an employee of Tucker Oil Company, sued appellant Texas Employers’ Insurance Association,, as carrier, in a district court of Wichita county, by appealing from an order of the Industrial Accident Board denying him compensation for am injury alleged to have been sustained while in the course of his employment.
