— Judgment of the Supreme Court, Bronx County (Lawrence H. Bernstein, J.), rendered February 4, 1987, convicting defendant Wilfredo Morales, after jury trial, of robbery in the first degree and sentencing him to an indeterminate term of imprisonment of 4 to 12 years, unanimously reversed on the law and the facts and as a matter of discretion in the interest of justice, the conviction vacated and a new trial ordered.

Defendant was convicted of the July 27, 1985 armed robbery of a Shopwell supermarket on Boston Post Road in Bronx County.
