The defendant was convicted of assault in the first degree after a jury trial in which the single issue was whether or not he was legally justified in firing two shots that severely wounded the complaining witness.

The evidence presented at the trial discloses strong support for the jury’s verdict, notwithstanding the unusual circumstance *462that the complaining witness had pointed a gun at the defendant before the defendant shot him, and that the complaining witness at first falsely testified that he did not possess a gun, testimony which he recanted, and…
