The appellee, W. P. McMullan, filed a bill of complaint in the chancery court of Scott county against the appellant, the Bankers’ Mortgage Company, and the Fidelity & Deposit Company of Maryland, its surety, seeking to recover the sum of six hundred fifteen dollars, alleged to be due the appellee on account of false representations of fact embodied in statements of appellant’s salesman and agent in a transaction involving the sale of installment investment bonds.
