ROBERT E. Quinn, Chief Judge:

The accused was convicted by general court-martial in Germany of negligent homicide and wrongfully leaving the scene of an accident in violation of Article 134, Üniform Code of Military Justice, 50 USC §728.. He was sentenced to a bad-conduct discharge, total feitures, and confinement . at hard labor for eighteen months. Following approval by the convening authority, an Army board of review set the findings aside for reasons hereinafter more fully described.
