This action was brought by the plaintiff against defendants to recover damages for personal injuries, under the provisions of § 33 of the Merchant Marine Act of 1920 (46 U. S. C. A., § 688). The cause was tried to the court and a jury, and resulted in a verdict in favor of plaintiff in the sum of five thousand dollars. The defendants moved for judgment notwithstanding the verdict, or, in the alternative, a new trial. The court granted the motion for judgment notwithstanding the verdict, and denied the motion for a new trial. Judgment was entered dismissing the action. Plaintiff…
