Appeal by defendant from an order of the district court for Winonacounty, Snow, J., denying a motion for judgment notwithstanding the-verdict or for a- new trial.

This action was brought to recover damages for the loss of a horse-which the complaint alleges was killed by reason of the failure of the defendant to fence its railroad. On the trial of the cause and at the-close of the evidence* the defendant requested the trial court to instruct the jury to return a verdict in its favor. This was denied, cause submitted to the jury, and a verdict returned for the plaintiff in the sum of *399$650. The defendant appealed from an order denying its motion for judgment notwithstanding the verdict or for a new trial.
