While assigned as a cook’s helper in the officers’ mess at Fort Leslie J. Mc-Nair, Washington, D. C., the accused was charged with willful disobedience of a lawful command of his superior officer, in violation of Article 90, Uniform Code of Military Justice, 50 USC § 684. As several defenses to the specification, he asserted that he was physically unable to comply and that his assignment to the particular duty was illegal and, therefore, the order given was without validity.
