In this action for damages for personal injuries, plaintiff Eugene C. Hinman, an intervener, City of Los Angeles, appeal from a judgment for defendant Westinghouse Electric Company entered after a jury verdict and from an order denying motions for judgment notwithstanding the verdict. 1

Plaintiff, a Los Angeles policeman, was standing on the center divider of a freeway inspecting a possible road hazard when he was struck by a car driven by Frank Allen Herman, an employee of defendant Westinghouse. 2 As a result of the accident he received permanent injuries. The city paid his…
