On June 1, 1949, the defendant, who was then 22 years old, was arraigned in the Carroll County Superior Court on a complaint of the county solicitor, the defendant having waived indictment; the complaint charged the defendant with breaking and entering in the nighttime, with the intent to steal goods in the store, and with stealing from the store.

The defendant pleaded guilty and was sentenced to the New Hampshire State Prison for not more than fifteen years nor less than ten years. The defendant was committed under this sentence, twice paroled, and twice recommitted for violation of parole.…
