MEMORANDUM OPINION AND ORDER

Plaintiff Emilio A. Pascual brought this action pursuant to sections 205(g) and 1631(c)(3) of the Social Security Act (“the Act”), as amended, codified at 42 U.S.C. § 405(g) and § 1383(c)(3), to review the final determination of the Secretary of Health and Human Services (“the Secretary”) denying his applications for Social Security Disability Insurance benefits (“SSD”) and Supplemental Security Income Disability benefits (“SSI”).
