The Insurance Commissioner, as statutory liquidator of an insurance company, brought this action to recover from the defendant the amount of certain assessments levied by him in the course of the liquidation of the company’s affairs. The defendant filed an affidavit of defense and a counter-claim. The plaintiff filed a rule for judgment for want of a sufficient affidavit of defense and an “affidavit of defense in lieu of a demurrer to the counter-claim.” The learned court below made the rule for the judgment for want of a sufficient affidavit of defense absolute, and…
