DODGE, Circuit Judge.
The District Court held in this case that United States patent 717,296, issued December 30, 1902, to the appel-lee company (hereinafter called plaintiff), as assignee of Frank Spald-*888ing, was valid, and that the appellant company (hereinafter called defendant) had infringed both the claims thereof.
The patent is entitled “Micrometer Calipers.”
[ 1 ] The specification begins:
“This invention has reference to an improved device for clamping the spindle of a micrometer caliper or gage.”
