This action arises out of events that occurred some months prior to the voluntary petition filed on February 13, 1987, by Kroh Brothers Development Company (“KBDC”), under Chapter 11 of the Bankruptcy Code. Plaintiffs predecessors, KBDC and the Kroh Operating Limited Partnership (“KOLP”), filed the above-captioned action in order to recover a setoff and preferential transfers allegedly received by defendant United Missouri Bank of Kansas City, N.A.
