McMILLIAN, Circuit Judge.

Martin Diaz appeals from a final judgment entered in the District Court 1 for the Eastern District of Missouri, following a bench trial on certain stipulated facts, finding him guilty of conspiracy to possess with intent to distribute cocaine in violation of 21 U.S.C. § 846. The district court sentenced Diaz to ten years imprisonment. For reversal Diaz argues that the district court erred in (1) denying his motion to suppress a tape-recorded conversation that occurred in his house, (2) denying his motion to suppress certain tape-recorded telephone conversations, and…
